Overview

  1. The Shared Ownership Code is an independent body which is constituted as a not-for-profit company limited by guarantee, created to implement an industry Code of Practice, the Shared Ownership Code (‘the Code’).
  2. The arrangements introduced and overseen by the Shared Ownership Code are fully funded from registration-based payments from housing providers.
  3. In applying to register with the Shared Ownership Code you are committing to the stated objectives of the Shared Ownership Code that are:
    1. Raise standards to improve protections for current and future shared owners.
    2. Improve customer experience of shared ownership through a clear and fair understanding prior to purchase and support during ownership and at sale.
    3. Ensure best practice and drive consistency in the information available to customers, including ensuring transparency, fairness and awareness of what service levels to expect.

Fees

  1. Payment to Shared Ownership Code (whether in full or by instalments) represents your annual fee to be a Code Adopter (or Pending) with the Shared Ownership Code (Registration Fee).
  2. Your registration fee will enable the Shared Ownership Code to deliver its objectives, as set out in 3 above.
  3. The fee is based on the number of shared ownership homes owned and shared ownership pipeline sales to be handed over in the current financial year.
  4. The renewal of fees will take place 12 months after submission of your application to register with Shared Ownership Code and every 12 months thereafter (unless you have a separate agreement for a different period). Shared Ownership Code reserves the right to change the renewal date in future years for ease of administration purposes and commits to providing no less than 3 months’ notice of any such changes.
  5. The annual registration fee charged by the Shared Ownership Code covers the following elements:
    1. Application to be on the Shared Ownership Code housing provider Code Adopter Directory, this includes, subject to acceptance of the application and activation, to describe itself as a Code Adopter (or Pending) and to demonstrate to customers its support for the Code and the objectives of Shared Ownership Code.
    2. The operational costs of the Shared Ownership Code.
    3. Access to a training module for employees and agents such that they understand the requirements of the Code and how to comply.
    4. Logos for the Shared Ownership Code (only available to Code Adopters) and the associated brand guidelines so that housing providers can update their marketing materials, sales centres and websites as required by the Code.
    5. Access to a suite of other resources to enable developers to comply with the requirements of the Code.
  6. There are some circumstances that may dictate that the Shared Ownership Code’s aims and services cannot be fulfilled on an ongoing basis; or where housing providers will not be able or permitted to continue as Code Adopters (Pending). These circumstances may include (but are not exhaustive):

Shared Ownership Code do not accept an application for RegistrationThe Shared Ownership Code will undertake various validation checks on each housing provider and their directors, including confirmation that necessary steps have been taken to ensure compliance with the Code requirements.
If a housing provider fails these checks then the application will be rejected.
Housing providers fail to activate their registration within 6 months of applicationIt is expected that following the application to register, housing providers will activate their registration within 6 months.
The Shared Ownership Code will work closely with housing providers to assist them prepare to activate.
Failure to activate (for at least one part of the business) within 6 months (or such later date Shared Ownership Code may agree) without justification could lead to the application being cancelled.
  1. The registration fee is not refundable or cancellable. It is non-transferable. In the event of a merger or acquisition of a housing provider, the Shared Ownership Code reserves the right to require a new application to be submitted. Once an application has been made, the entire annual fee will be due and payable. Excepting that in the event of any of the above circumstances applying as set out in paragraph 9, up to 50% of the annual registration fee may be refunded at the discretion of the Shared Ownership Code. The remainder will be retained to cover the costs of the setup and management of the Shared Ownership Code which have been and will be incurred.
  2. In the event that your registration is cancelled due to sanctions being applied by the Shared Ownership Code Disciplinary & Sanctions Committee then no monies will be refunded in any circumstance. This is expected to be applied in the most serious instances, and a range of other sanctions including re-training and attestation will be available to that Committee.
